Terms of Use for Fleck: AI Journal

1. Personal journaling

Fleck helps you capture voice or typed journal entries, transcribe recordings, and generate daily reflections or sketches from your journal content. You are responsible for what you record, write, save, export, or share.

2. Age

Fleck is designed for adults and is not intended for children under 13. If you are under the age at which you can agree to these Terms on your own where you live, you may use Fleck only with permission from a parent or legal guardian.

3. Not medical, therapy, legal, financial, or emergency advice

Fleck and its AI-generated reflections are for personal journaling and reflection only. Fleck is not a medical, mental-health, therapy, legal, financial, crisis, or emergency service. AI-generated content may be incomplete, inaccurate, or inappropriate for your situation.

If you are in danger, in crisis, or need urgent help, contact local emergency services, a crisis hotline, or a qualified professional.

4. Subscriptions, billing, and introductory offers

Fleck may offer subscriptions and may offer an introductory trial or discount where shown in the app or store purchase flow. The applicable store displays current prices, billing periods, offer eligibility, renewal terms, and cancellation rules before you purchase.

Apple handles purchases made through the App Store on iPhone. Google handles purchases made through Google Play on Android. Subscriptions automatically renew unless canceled through the store account used to purchase before the renewal deadline shown by that store. Veld does not directly receive your full payment-card details.

Manage or cancel through your App Store or Google Play account, depending on where you purchased. App Store and Google Play purchases do not automatically transfer between platforms because Fleck does not have a user account that links the two stores. Deleting Fleck does not cancel a subscription. Refunds, where available, are handled under the applicable store’s policies.

5. Store terms

If you download Fleck through Apple’s App Store, Apple’s Standard End User License Agreement also applies unless Apple or Veld provides a different license. Apple’s applicable terms control for App Store-managed billing, refunds, and subscription matters if they conflict with these Terms.

If you download Fleck through Google Play, Google Play’s applicable terms also apply. Google’s applicable terms control for Google Play-managed billing, refunds, and subscription matters if they conflict with these Terms.

6. Your content

Your journal entries, recordings, transcripts, edits, exports, and generated sketches remain your content. You grant Veld and the processors needed to operate Fleck permission to process your content only as reasonably necessary to provide, maintain, secure, troubleshoot, and support Fleck’s features, including transcription, AI generation, subscription access, and support.

Do not use Fleck to record or store content you do not have the right to record or use, or content that violates another person’s rights, privacy, or safety.

7. Privacy

The Fleck Privacy Policy explains what information Fleck processes, what is stored on your device, when information may leave it, and what outside services are used.

8. Acceptable use

You may not:

• reverse engineer, disrupt, overload, or abuse Fleck or its outside services except where applicable law expressly permits otherwise;
• use Fleck to violate laws or another person’s rights;
• bypass subscription, entitlement, usage, security, or access controls;
• use Fleck to generate, store, or distribute unlawful, harmful, or abusive content; or
• use automated systems to access Fleck in a way that harms the service or other users.

9. Availability and changes

Fleck may change over time. We may add, remove, modify, suspend, or discontinue features, including free or paid features, where appropriate. We try to keep Fleck reliable but do not guarantee that the app or an outside service will always be available, error-free, or uninterrupted.

10. Disclaimers

Fleck is provided “as is” and “as available.” To the fullest extent permitted by law, Veld disclaims warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, availability, and reliability. Nothing in these Terms excludes warranties or rights that cannot legally be excluded.

11. Limitation of liability

To the fullest extent permitted by law, Veld will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, profits, goodwill, or other intangible losses arising from or related to your use of Fleck. This limitation does not apply where liability cannot legally be limited.

12. Governing law

These Terms are governed by the laws of the State of Utah, without regard to conflict-of-law rules, except where the laws of your location require otherwise.

13. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will update the date above and may provide additional notice where appropriate. Your continued use of Fleck after updated Terms take effect means you accept them, to the extent permitted by law.
