Terms of Use for Fleck: AI Journal

1. Fleck is for personal journaling

Fleck helps you capture short voice or typed journal entries, transcribe recordings, and generate personal daily reflections or sketches from your own journal content. You are responsible for the entries you create and for deciding what information you choose to record, write, save, export, or share.

2. Not medical, therapy, legal, financial, or emergency advice

Fleck and its AI-generated reflections are intended for personal journaling and reflection only. Fleck is not a medical, mental health, therapy, legal, financial, crisis, or emergency service. AI-generated content may be incomplete, inaccurate, or inappropriate for your situation.

If you are in danger, in crisis, or need urgent help, contact local emergency services, a crisis hotline, or a qualified professional.

3. Subscriptions, billing, and trials

Fleck may offer paid subscriptions, including monthly or annual options, and may offer a free trial where shown in the app or app store listing. Prices, billing periods, trial availability, renewal terms, and cancellation rules are shown in the app store purchase flow before you confirm a purchase.

On iOS, purchases are handled by Apple’s App Store. On Android, purchases are handled by Google Play. Your subscription automatically renews unless canceled through the app store account used to purchase it before the renewal deadline shown by Apple or Google. Veld does not directly receive your full payment card details.

You can manage or cancel your subscription through your Apple account settings or Google Play account settings, depending on where you purchased the subscription. Refunds, if available, are handled according to the policies of Apple or Google.

If you download Fleck through Apple’s App Store, Apple’s Standard End User License Agreement also applies to your use of the app, unless Apple or Veld provides a different license agreement. If these Terms conflict with Apple’s applicable terms for App Store billing, refunds, or subscription management, Apple’s applicable App Store terms control for those platform-managed matters. If you download Fleck through Google Play, Google Play’s applicable terms may also apply to purchases, refunds, and subscription management.

4. Your content

Your journal entries, recordings, transcripts, edits, exports, and generated sketches remain your content. You grant Veld and the third-party processors needed to operate Fleck permission to process your content only as needed to provide, maintain, troubleshoot, and support Fleck’s features, including transcription, AI generation, subscription access, and support.

You should not use Fleck to record or store content that you do not have the right to record or use, or content that violates the rights, privacy, or safety of others.

5. Privacy

Fleck’s Privacy Policy explains what information Fleck processes, when information may leave your device, and what third-party services are used. Please read the Privacy Policy at getveld.ai/fleck/privacy.html.

6. Acceptable use

You agree not to misuse Fleck. For example, you may not:

• attempt to reverse engineer, disrupt, overload, or abuse Fleck or its third-party services;
• use Fleck to violate laws or the rights of others;
• try to bypass subscription, entitlement, usage, security, or access controls;
• use Fleck to generate, store, or distribute unlawful, harmful, or abusive content; or
• use automated systems to access Fleck in a way that harms the service or other users.

7. Availability and changes

Fleck may change over time. We may add, remove, modify, suspend, or discontinue features, including free or paid features, where appropriate. We try to keep Fleck reliable, but we do not guarantee that the app or any third-party service will always be available, error-free, or uninterrupted.

8. Disclaimers

Fleck is provided “as is” and “as available.” To the fullest extent permitted by law, Veld disclaims warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, availability, and reliability. You use Fleck at your own discretion and risk.

9. Limitation of liability

To the fullest extent permitted by law, Veld will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, profits, goodwill, or other intangible losses arising from or related to your use of Fleck.

10. Children

Fleck is not intended for children under 13. If you are under 13, do not use Fleck.

11. Governing law

These Terms are governed by the laws of the State of Utah, without regard to conflict-of-law rules, except where your local law requires otherwise.

12. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will update the effective date above and may provide additional notice where appropriate. Your continued use of Fleck after the Terms are updated means you accept the updated Terms.
